An Act Respecting the Apprenticeship and Occupational Certification Act
His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Apprenticeship and Occupational Certification Act
1( 1) Section 13 of the Apprenticeship and Occupational Certification Act, chapter 19 of the Acts of New Brunswick, 2012, is amended
(a)  in paragraph (1)(c)
( i) in clause (iv)(B) of the French version by striking out the semicolon at the end of the clause and substituting a comma;
( ii) by adding after subparagraph (iv) the following:
( v) any standards and requirements to be met by a person who holds a credential equivalent to a certificate of qualification or diploma of apprenticeship issued under this Act that is issued by another province or a territory of Canada,
(b)  by adding after subsection (4) the following:
13( 5) An order made under subparagraph (1)(c)(v) may establish classes of persons for the purpose of the standards and requirements prescribed and may prescribe different standards and requirements for different classes of persons.
1( 2) The Act is amended by adding after section 13 the following:
Certificate of qualification or diploma of apprenticeship from another Canadian province or a territory
13.1 A person who holds a credential equivalent to a certificate of qualification or diploma of apprenticeship that is issued by another province or a territory of Canada and who meets any standards and requirements prescribed by the Board in an order under subparagraph 13(1)(c)(v) is deemed to hold a certificate of qualification or diploma of apprenticeship, as the case may be, issued under this Act.
1( 3) The Act is amended by adding after section 43 the following:
Compliance orders
43.1( 1) If an education and compliance officer is satisfied that a person has failed to comply with any provision of this Act or the regulations, the education and compliance officer may issue a compliance order.
43.1( 2) A compliance order issued under subsection (1) shall
(a)  set out the provision of this Act or the regulations that the person failed to comply with and a description of that failure to comply,
(b)  set out any action the person must take to remedy the failure, and
(c)  specify the time period within which the order must be complied with.
43.1( 3) If a person fails to comply with a compliance order before the expiry of the time period specified, the education and compliance officer may impose an administrative penalty on the person in accordance with section 44.
Review of compliance orders
43.2( 1) A person affected by a compliance order may request that the Director review the order by applying to the Director in accordance with the regulations.
43.2( 2) Subject to the regulations, the Director shall establish the procedure to be followed with respect to a review requested under subsection (1).
43.2( 3) On review, the Director may confirm, vary or rescind the order.
43.2( 4) A decision of the Director under subsection (3) is final.
1( 4) Subsection 56(1) of the Act is amended by adding after paragraph (l):
(l.1)  establishing the procedure to be followed with respect to the issuance of a compliance order;
(l.2)  establishing the procedure to be followed with respect to a request for a review of a compliance order;
(l.3)  respecting reviews of compliance orders;
Regulation under the Apprenticeship and Occupational Certification Act
2 New Brunswick Regulation 2012-67 under the Apprenticeship and Occupational Certification Act is amended
(a)  by repealing section 3 and substituting the following:
3 The fee payable for registration as an apprentice under the Act is as follows:
(a)  for a person registered as an apprentice in another province or a territory of Canada, $0; and
(b)  for any other person, $25.
(b)  in section 7
( i) in paragraph (a) of the English version by striking out “him or her” and “and” at the end of the paragraph;
( ii) in paragraph (b) by striking out “grant him or her credits under section 24 of the Act, $100.” and substituting “grant credits under section 24 of the Act, $100;”;
( iii) by adding after paragraph (b) the following:
(c)  for assessing the training or work experience of a person registered as an apprentice in another province or a territory of Canada for the purpose of determining whether to grant credits under section 24 of the Act, $0.
(c)  in section 8
( i) in paragraph (a) of the English version by adding “and” at the end of the paragraph;
( ii) by repealing paragraph (b).
CONSEQUENTIAL AMENDMENTS AND COMMENCEMENT
Free Trade Within Canada Act
3 Section 2 of the Free Trade Within Canada Act, chapter 44 of the Acts of New Brunswick, 2025, is amended by adding after paragraph (a) the following:
(a.1)  services that may only be provided by the holder of an occupational certificate referred to in the Apprenticeship and Occupational Certification Act, or
Commencement
4 This Act comes into force on September 1, 2026.
